ANI vs OpenAI: Delhi HC has jurisdiction under Indian copyright law, say experts
By Staff Writer in Media News on Thursday, 30th January 2025 at 8:22pmCourt-appointed experts have asserted that the Delhi High Court possess the jurisdiction to adjudicate the ongoing lawsuit between Asian News International (ANI), a leading Indian news agency and the US AI giant OpenAI.
In an article, The Hindustan Times reported that “under the Indian Copyright Act, the jurisdiction is determined by the place of business of the plaintiff, which is New Delhi in this case”.
According to the report submitted by the court-appointed experts, academic Arul George Scaria and lawyer Adarsh Ramanujan stated, despite OpenAI’s servers being located outside India, the court has jurisdiction. This is because OpenAI’s “interactive services” are available to users in India, including those in Delhi, where ANI’s headquarters are located.
